The code requires employers to keep up-to-date information where there is an agreement on overtime: employees paid exclusively by incentive pay such as commission, piecework or a similar method do not have a fixed rate of pay. Therefore, the rate of pay for calculating overtime duties is considered a minimum wage. If the incentive wage is less than what would have been earned with the minimum wage, the employer must charge the wages with the incentive. 10. At the written request of the worker, the employer and the worker may agree to adapt the work plan to subsection 2. (a) (iv) provided that the total number of hours stipulated in the agreement remains unchanged. The FAR rules also require contractors to comply with federal wage and hourly laws regarding the payment of overtime to non-exempt workers. The Employment Standards Regulation excludes a number of occupations from these sections. The regulation also provides specific rules for calculating overtime for several other occupations. If the employer or worker leaves the employment relationship through a written dismissal, the employer is prohibited from requiring the worker to use certain overtime or overtime hours during the notice period, unless both parties agree.
